Supreme Court Affirms Agbu As Taraba PDP Guber Candidate

February 03, (THEWILL) – The Supreme Court has affirmed Colonel Kefas Agbu (retd) as the governorship candidate of the Peoples Democratic Party (PDP) for the March 11 governorship election in Taraba State.

The ruling followed an appeal filed by Professor Jerome Nyameh challenging the May 25, 2022, governorship primary election that produced Kefas as the governorship candidate of the PDP in Taraba State.

Nyameh had challenged the ruling of an Appeal Court in Yola, Adamawa State, which dismissed two different suits, challenging the eligibility of Agbu to contest the governorship primary election.

In a unanimous judgement of a panel of Justices, led by Emmanuel Akomaye Agim, the apex court dismissed the appeal by Professor Nyameh.

It held that the appellant failed to join other aspirants that participated in the primary election as defendants as required by law.

The court also held that Nyameh failed to explore the internal mechanism for peaceful resolution of the primary election before rushing to court to institute the suit.

According to the apex court, the law was clear on conditions precedent to be complied with before any aggrieved governorship aspirant could rush to court.

Justice Agim, therefore, affirmed Agbu Kefas, as the governorship candidate of PDP in Taraba State for the 2023 election.
