Ochei Asks Federal Court To Quash Delta APC Governorship Primary, Suit Gets Accelerated Hearing

BEVERLY HILLS, October 18, (THEWILL) – Rt. Hon. Victor Ochei, a former speaker of the Delta State House of Assembly and governorship aspirant of the All Progressives Congress, APC, in Delta State has asked Justice Nnamdi Dimgba of the Federal High Court Abuja to nullify the governorship primary of his party in the state saying that the primary was conducted with delegates other than the ones approved in the Consent Judgment delivered by Justice Anwuri Chikere of the High Court.

Ochei’s lawsuit marked FHC/ABJ/CS/1085/ 2018, has the APC, Chief Great Ogboru, who was declared winner of the disputed primary election and the Independent National Electoral Commission, INEC as Defendants.

The Plaintiff, through his lawyer Mr. Ahmed Raji, SAN, prayed the court to declare that the APC gubernatorial primary election that held on September 30, was illegal and unlawful on the ground that delegates not known to law were used for the exercise.

He averred that the High Court had in a judgment that was delivered by Justice Chikere on June 19, authenticated a list of delegates of APC in Delta state. He said the party unlawfully altered, circumvented and did not use the lawful Delegates List for the election.

The former Speaker told the court that contrary to the judgment, the APC leadership used unknown delegates for the primary poll.

THEWILL had previously reported that the primary election was marred by irregularities including non-accreditation of delegates as well as violence.

Consequently, he urged the court to nullify the purported primary election for being unlawful, unjust and deliberately carried out in disregard of subsisting judicial directive.

Ochei equally prayed the court for an order compelling the APC to immediately conduct a fresh primary election with the list of delegates endorsed in the Consent Judgment. He also prayed the court to make an order of perpetual injunction restraining INEC from accepting or recognizing Ogboru as the winner of the disputed primary.

In his 40-paragraphed supporting affidavit, the Plaintiff told the court that he was denied fair participation in the primary election despite paying N22.5million for Expression of Interest and Nomination Forms. He insisted that the court’s order was brazenly violated by the national leadership of the party in the conduct of the primary poll election.

Ogboru and INEC through their counsel, Chief Adeniyi Akintola, SAN, have filed preliminary objections to challenge the competence of the suit.

Justice Dimgba therefore adjourned the suit till November 13 for adoption of all processes filed. The matter has been slated for accelerated hearing.
