Judgement 1: Osinbajo Is ‘Not Indispensable’ – Tribunal Rules

SAN FRANCISCO, September 11, (THEWILL) – The first Preliminary Objection filed by the Independent National Electoral Commission (INEC) asking the tribunal to dismiss the petition of the Peoples Democratic Party (PDP) and its candidate, Atiku Abubakar, for not joining Vice-President Yemi Osinbajo who participated in the election as a necessary party has been dismissed.

The PDP and its candidate are seeking to nullify the election of President Muhammadu Buhari in the February 23 poll.

The petition has INEC, Buhari and the ruling All Progressives Congress (APC) – in that order – as respondents.

However, INEC had asked that Vice-President Osinbajo be joined alongside Buhari as a party in the petition filed by Atiku. The commission had said Osinbajo deserves a right to fair hearing as a co-winner of the election.

In its ruling, the five-man panel led by the Chairman, Justice Mohammed Garba, dismissed it citing relevant laws and decided cases.
