Embattled Domestic Airline Operators To Return To Court March 11

BEVERLY HILLS, January 14, (THEWILL) – Federal High Court sitting in Abuja has adjourned till Thursday, March 11, 2021 a suit filed by West Link Airlines LTD, Sky Power Express Airways Nigeria Limited and Tropical Attic Logistics LTD against Airline Operators of Nigeria (AON) and nine others.

The plaintiffs are contesting the processes that led to the election and emergence of the new executives of the airline body on the September 16, 2020.

They are also seeking an interlocutory injunction calling for the elections held to be declared null and void and restraining the current executives of the airline body from parading themselves as executives, trustees of the airline body.

At the resumed hearing of the suit filed at the Justice Ahmed Mohammed Federal High Court in Abuja with number FHC/ABJ/1336/2020, counsel to the defendant opposed the plaintiffs Lawyer’s attempt to argue a motion for an interlocutors injunction on grounds that the matter was listed for mention.

Justice Ahmed after listening to the parties set the hearing for March 11, 2021.

Counsel to the Plaintiff, Barrister Marcel Oru who spoke to reporters after the hearing stated: “Failure to invite seventeen others (airlines) for the Annual General Meeting of the AON was wrong and unconstitutional.

“Unfortunately, the court could not proceed because the matter was adjourned till today for mention, but we have a motion for interlocutors’ injunction to restrain the AON.

“Some members of AON were intentionally excluded from attending the AGM which resulted in their grievance that is why they are in court. It is unfortunate that the court cannot proceed today but we have a motion before the court restraining the executives from doing anything or acting on behalf of the AON until the matter is resolved.”

Recall that sometime in October some AON members filed an interlocutory injunction calling for the elections held to be declared null and void and restraining the current executives of the airline body from parading themselves as executives, trustees of the airline body.

The plaintiffs are seeking to set aside the purported Annual General Meeting of the Airline Operators of Nigeria (AON) held on September 16, 2020 declaring it unconstitutional and fraught with manifold irregularities and should be declared null and void.
