Ekiti: Supreme Court Upholds Fayemi’s Election

SAN FRANCISCO, May 24, (THEWILL) – The Supreme Court has upheld the election of Governor Kayode Fayemi of Ekiti State.

At its sitting on Friday, the court dismissed the appeal filed by the Peoples Democratic Party (PDP) and Kolapo Olusola, its governorship candidate, challenging Fayemi’s victory.

In the lead judgment by Justice John Okoro, the court held that the appeal was unmeritorious and proceeded to uphold an earlier judgment by the Court of Appeal, Abuja, which affirmed the decision of the election tribunal, to the effect that Fayemi was validly elected.

THEWILL recalls that the Independent National Electoral Commission (INEC) had declared Fayemi winner of the election.

But Olusola challenged his victory at the tribunal, alleging that the election was fraught with irregularities. The tribunal, however, struck out his case and ruled that Fayemi was credibly elected governor of the state.

The court of appeal sitting in Abuja also delivered a similar ruling after the case was filed before it. Olusola then proceeded to the Supreme Court, asking it to nullify the judgements given by the tribunal and the appelate court in Fayemi’s favour.

However, a five-man panel of the apex court, led by Tanko Muhammad, acting Chief Justice of Nigeria (CJN), however, dismissed the appeal on the ground that it lacked merit.
