Djokovic Loses Appeal Against Visa Revocation, To Be Deported

January 16, (THEWILL) – After losing his appeal against his visa being revoked, Novak Djokovic now faces deportation from Australia a day before the first Grand Slam of the year begins.

The decision by Australia’s Immigration Minister, Alex Hawke, to withdraw the world number one’s visa for the second time was supported by the court this time.

THEWILL recalls that Djokovic’s visa had been revoked after he failed to meet the requirements for a medical exemption. However, a federal court overturned the ruling, prompting Hawke to rescind the visa on “health and good order grounds.”

The nine-time Australian Open champion appealed the verdict, but the Minister’s decision was upheld. The lawyers for the world number one contended that the Australian government’s decision was “illogical, irrational, or unreasonable.”

The court’s verdict focused on whether the decision to deport Djokovic was illogical to the point of being unlawful, rather than “the merits or wisdom of the decision,” according to Chief Justice James Allsop, who explained the conclusion made by a three-judge panel.

In a statement, Djokovic said he was “extremely disappointed” but that he would cooperate with the decision: “I will cooperate with the relevant authorities in relation to my departure from the country.”

On Monday, the 20-time Grand Slam winner was set to start the defence of his Australian Open title against Miomir Kecmanovic. The decision to deport Djokovic means he will miss out on a chance to capture a record-tying 10th Grand Slam title at Melbourne Park.

Along with Rafael Nadal and Roger Federer, Djokovic has won 20 Major titles. The 34-year-old will have to wait till the French Open at Roland Garros to try for a record-breaking 21st Grand Slam championship.
