November 03, (THEWILL) – The Peoples Democratic Party (PDP) has asked an Abuja Federal High Court to sack the Abdullahi Adamu-led National Working Committee (NWC) of the All Progressives Congress (APC), citing illegality in the process that produced the party’s national officers and candidates.
The suit filed on behalf of the PDP by Ayo Kamaldeen Ajibade, (SAN), before Justice Inyang Edem Ekwo of the Federal High Court, according to the party, was predicated on a judgment of the Court on September 30, 2022, which declared all actions and activities of the dissolved Extraordinary Convention Committee of the APC led by Gov. Mai Mala Buni as illegal, unlawful and unconstitutional.
The Abdullahi Adamu-led NWC took over the affairs of APC after the party’s national convention in March this year.
According to the suit, the PDP argued that the Adamu-led APC NWC acted in illegality in the process that produced the party’s national officers and candidates.
It therefore demanded that all candidates produced by APC for the 2023 general elections be disqualified having been allegedly produced in breach and gross violation of the 1999 Constitution and Electoral Act 2022.
Meanwhile, the Chief Judge of the Federal High Court, Justice John Tsoho has assigned the suit, marked FHC/ABJ/CS/1864/2022 to Justice Inyang Ekwo for determination.
Justice Ekwo has fixed November 22, for mentioning of the suit with an order that all the 53 persons listed by PDP in the suit as defendants be served with hearing notices in their respective locations.
The Court process sighted on Wednesday showed that the Presidential candidate of the APC, Bola Ahmed Tinubu, his running mate, Kashim Shetima, all Governorship candidates and their deputies are listed in the request for disqualification from the 2023 election on the ground that their nominations are in breach of the Constitution and Electoral laws.
Also listed in the request for disqualification from the 2023 general elections are the Senatorial and House of Representatives candidates of the party.
