San Francisco Jan 13, (THEWILL) – As the controversies surrounding President Umaru Yar’Adua’s absence from the country continues, an Abuja Federal High Court ruled on Wednesday that the Vice President can act as President only if the President transmits a letter to the National Assembly. Justice Dan Abutu also ruled that the Vice President has been performing Presidential duties as assigned by the President, but there are some clouds surrounding the Judge's ruling.

THEWILL has not been able to independently confirm reports that the case which was brought before Justice Abutu about five days ago was a scheme by the Attorney General Mr. Michael Aondoakaa to get a favourable ruling for the Presidency.

THEWILL is working its sources to get a hold of the Judgement which we shall attach to this report as soon as we lay hands on it.

A Nigerian lawyer, Christopher Onwuekwe had filed a suit at the court praying the court to declare that the Vice President has powers to act as President even though the President has refused to write the National Assembly.

Onwuekwe through his lawyer, Amobi Nzelu told the court that the President’s refusal to transmit a letter to the National Assembly has created a vacuum at the executive arm of government, thereby threatening the stability and security of the country.

THEWILL was not able to reach the President’s spokesman, Mr. Segun Adeniyi to comment on the ruling.
