Lagos (THEWILL) - The Court of Appeal in Enugu friday, threw out the suit filed by Chief Andy Uba praying the judges to declare him "Stand by Governor" of Anambra State. Uba had asked the judges to validate the governorship election he won in 2007.

The Judges in dismissing my Uba's suit, said the election in question should not have held in the first place, since there was a sitting governor in office at that time.

Lead Justice Ngwuta noted that the said election, "was a nullity ab initio and a flagrant abuse of the Supreme Court rules, which says that an election into the governorship seat must be conducted 60 days to the expiration of the tenure of the incumbent or 30 days after"

With this ruling, the former presidential aide's dream of becoming governor of his home state seem to have come to a dead end. His political party, the PDP, last month nominated Professor Chukwuma Soludo, to be its candidate in the 2010 governorship poll via a controversial nomination process.
