Los Angeles (THEWILL) - Joe Jackson has filed a petition in a Los Angeles Superior Court challenging his exclusion from receiving monthly allowances from the late singer’s estate.

According to the court document, the elderly father of Michael Jackson claimed the singer gave him $30,000 monthly through Katherine, his mother.

He says there is “no justification” for the estate to stop giving “him his own independent allowance”.

Joe Jackson claims his monthly needs exceed $25,000 dollars, and that his Social Security income is a paltry $1, 700 dollars saying the estate is “Well able to afford a family allowance for Joe Jackson.”

The Friday petition claims the estate “has earned more than a $100 million dollars in the first seven weeks following Michael Jackson’s death.” Analysts are estimating the estate may earn another $100 million by the end of the year.

Michael’s movie, “This Is It” has taken in over $140 million dollars worldwide since it opened. The movie sound track has topped the US record charts since its release.

The Superior Court judge as at today has not given a date for ruling on the petition.
